5. Capacity Lab & Memberships

Capacity Lab and any related membership, community, or digital product are designed for educational, personal development, reflection, community, and practical application purposes.

Membership access may include prompts, video guidance, tools, worksheets, downloadable materials, community areas, guest sessions, recordings, discussions, or other content as made available from time to time.

Membership features, content, access, schedule, guest sessions, live sessions, resources, and community structure may change over time. We may add, remove, pause, update, replace, or modify membership features at our discretion.

If a membership includes a minimum commitment, initial term, renewal period, or cancellation restriction, those terms will be stated on the relevant sales page, checkout page, or membership agreement. Capacity Lab is not therapy, counseling, crisis support, medical care, or a substitute for professional mental health treatment. It is a personal development and educational community.

6. Payments, Billing & Subscriptions

By purchasing a product, joining a membership, registering for a paid offer, or entering into a paid agreement with us, you agree to pay all applicable fees, charges, taxes, and payment processing costs associated with that offer.

Payments may be processed by third-party payment processors or platform providers. By submitting payment information, you authorize us and our third-party payment providers to charge your selected payment method for the purchase, subscription, renewal, payment plan, or other payment arrangement you selected.

If you enroll in a subscription, membership, payment plan, or recurring billing arrangement, you authorize recurring charges according to the billing frequency and terms disclosed at checkout or in the applicable agreement.

You are responsible for keeping your payment method current. If a payment fails, we may retry the payment, contact you for updated payment information, suspend access, cancel access, or take other reasonable steps to collect amounts owed.

Prices are subject to change. Price changes will apply as stated in the relevant offer, checkout page, renewal notice, or applicable law. Existing members or customers may be notified of material changes when required.

7. Cancellations, Refunds & Chargebacks

Cancellations

Cancellation terms vary by offer. For memberships or subscriptions, you may cancel according to the cancellation instructions provided on the sales page, checkout page, account area, or written agreement.

If your offer includes a minimum commitment or initial term, cancellation may not stop payments due during that initial commitment period unless otherwise required by law or expressly stated in writing.

Canceling a membership or subscription may stop future renewals, but it does not automatically refund past payments, partial months, unused access, missed sessions, unviewed content, or unused materials unless a specific refund policy applies.

Refunds

Refunds, if available, will be governed by the refund terms stated on the applicable sales page, checkout page, proposal, invoice, contract, or written agreement at the time of purchase.

Unless a specific refund policy is stated for a particular offer, all purchases are final to the fullest extent permitted by law.

Digital Products & Downloadable Materials

Due to the nature of digital products, downloadable materials, courses, membership content, templates, recordings, and online resources, these purchases may be non-refundable once access has been granted, unless otherwise stated in writing.

Chargebacks

If you believe there has been a billing error, please contact us first so we can help resolve the issue. Initiating an improper chargeback for a valid purchase may result in suspension or termination of access and may require payment of any outstanding balance, chargeback fees, or collection costs allowed by law.

8. Speaking, Workshops & Custom Training

Speaking engagements, leadership workshops, custom training, organizational programs, consulting-style engagements, and private services may be subject to separate proposals, contracts, invoices, payment terms, cancellation terms, travel terms, preparation requirements, intellectual property terms, and usage rights.

If there is a conflict between these Terms and a signed written agreement for a speaking, training, workshop, or organizational engagement, the signed written agreement will control for that specific engagement.

Unless otherwise agreed in writing, custom training materials, slides, frameworks, recordings, worksheets, handouts, and related intellectual property remain the property of The Capacity Expert or the applicable rights holder.

Organizations may not record, reproduce, distribute, publish, sell, license, train others using, or repurpose speaking or training materials without prior written permission.

We may edit testimonials, comments, or submitted content for length, clarity, grammar, formatting, privacy, or readability, but we will not intentionally change the meaning of your words.

You represent that any content you submit is accurate to the best of your knowledge, does not violate the rights of others, does not contain unlawful material, and does not include confidential, sensitive, clinical, or third-party personal information that you do not have permission to share.

18. Disclaimers

The website, content, products, memberships, communities, services, resources, and materials are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, completeness, reliability, and uninterrupted or error-free operation.

We do not warrant that the website, platform, emails, downloads, videos, communities, or services will be secure, uninterrupted, error-free, virus-free, or available at all times.

We do not guarantee that any information provided through the website, products, memberships, services, communities, or content is complete, current, accurate, or suitable for your specific circumstances.

19. Limitation of Liability

To the fullest extent permitted by law, The Capacity Expert, RaQuel Hopkins, and our owners, team members, contractors, affiliates, partners, service providers, licensors, and representatives will not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or similar damages arising from or related to your use of the website, products, memberships, communities, services, content, or third-party platforms.

This includes, without limitation, damages for lost profits, lost revenue, loss of data, business interruption, emotional distress, reputational harm, loss of goodwill, loss of opportunity, unauthorized access, platform outages, or reliance on information provided through the website or services.

To the fullest extent permitted by law, our total liability for any claim related to the website, products, memberships, communities, services, or content will not exceed the amount you paid to us for the specific product or service giving rise to the claim during the three months before the claim arose, or one hundred dollars, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

We reserve the right to suspend, restrict, or terminate your access to the website, account, products, memberships, communities, events, services, or content at any time if we believe you have violated these Terms, misused our content, failed to pay amounts owed, disrupted the community, violated another person’s rights, or engaged in conduct that may harm us, our users, our business, or our platforms.

Termination or suspension does not relieve you of payment obligations already incurred. We may also remove or restrict access to user-submitted content where appropriate.

Sections that by their nature should survive termination will survive, including intellectual property, payment obligations, disclaimers, limitation of liability, indemnification, dispute terms, and any other provisions necessary to enforce these Terms.

Any dispute that cannot be resolved informally will be handled in the courts or dispute resolution forum with proper jurisdiction, unless a separate written agreement between you and us states otherwise.
